Basic Purpose

Positions in this job family are assigned responsibilities for using extensive and current nursing knowledge and investigative skills for planning, coordinating and conducting investigations; monitoring compliance of licensed/certified individuals as ordered; performing diverse projects related to the regulation of nursing; as well as coordinating and participating with city, state and federal agencies to enforce local, state and federal nursing practice laws for the safety and efficiency of patients, health care workers and the public.

Typical Functions

The functions performed in this job family will vary by level, unit and organization, but may include the following:

  • Organizes and conducts investigations of alleged or suspected violations of laws and rules related to the practice of nursing consistent with the Oklahoma Board of Nursing policies and procedures. Receives, reviews and responds to alleged violations and other information concerning possible violations of state or federal laws, including intake, processing, researching and responding to complaints and nursing practice related calls, email, and written communication.
  • Obtains information and gathers facts by conducting interviews with principles, complainants, witnesses and other sources; obtains evidence and maintains evidentiary chain of custody; works as needed with federal, state, and local government agencies on investigations; evaluates findings of investigations, prepares reports and recommendations for consideration in administrative hearings or legal action; maintains confidentiality of investigations; maintains an organized case file; assists prosecutor(s) in filing charges; prepares exhibits; and provides testimony in such actions as required.
  • Arranges for enforcement of Board decisions concerning discipline; administers the monitoring, evaluation, and reporting of compliance with Board decisions and terms of probations or other actions.
  • Demonstrates honesty, independent-thinking, and candor toward Board members, the Executive Director, Supervisors and coworkers, as well as to the general public. Conveys a positive and professional image for the Oklahoma Board of Nursing in interactions with applicants, licensees, attorneys, other agencies/groups, co-workers and Board members.
  • Communicates effectively both orally and in writing with internal and external customers, including peers, subordinates, supervisors and the public, in a positive, professional manner.
  • Obtains and serves investigative subpoenas as needed; retrieves revoked, suspended or surrendered licenses/certificates; interviews applicants for licensure in furtherance of licensing requirements as needed.
  • Prepares clear, accurate and concise written summaries and reports detailing the status of investigations and duties performed.
  • Advises the Director of Investigative Division and/or Chief Nurse Investigator on matters concerning investigations; prepares reports as requested concerning investigative activities; and performs related work as requested.

Level Descriptor

This is the basic level of this job family where employees are in training, under the supervision of the Director of the Investigative Division and/or the Chief Nurse Investigator, are assigned responsibilities involving beginning level work in the typical functions of this job family. The incumbent interacts with other divisions within the agency and with outside entities in obtaining evidence; presents cases through informal hearings; provides testimony in administrative licensure hearings; and analyzes evidence to determine if additional review is needed prior to final negotiations.

Education and Experience

Education and experience requirements at this level consist of an unencumbered, current Oklahoma RN license; bachelor's degree in nursing; seven (7) years of experience as a registered nurse with two (2) years in a nursing service position within the last five (5) years or previous investigative experience.

Knowledge, Skills, Abilities, and Competencies

Knowledge, skills, and abilities required at this level includes knowledge of state and federal laws and rules pertaining to the practice of nursing; of the principles of investigations and negotiation; and computer software. Skill is required to effectively obtain needed information and maintain relationships with internal and external partners. Ability is required to remain objective; interpretation, analysis and evaluation of information obtained; deliver concise, complete, factual reports, both orally and in writing; handle simultaneous, multiple assignments in an organized manner, often with interruptions and under strict deadlines; organize priorities; establish and maintain effective working relationships with individuals and groups; handle confidential work with tact and discretion; and exercise professionalism.

Special Requirements

Some agencies require the selected applicant to have a current Oklahoma driver's license. Some agencies prefer management/supervision experience. Some agencies prefer a master's degree.
